4.1 Medical Weight Loss Our medical weight loss programs, which may include the use of GLP-1 receptor agonists (e.g., Semaglutide, Tirzepatide), are provided solely at the discretion of our licensed medical providers following a comprehensive evaluation.

FLORIDA WEIGHT-LOSS CONSUMER BILL OF RIGHTS Pursuant to Florida Statute § 501.0575, the following rights apply to all consumers of our weight-loss programs:
(A) WARNING: RAPID WEIGHT LOSS MAY CAUSE SERIOUS HEALTH PROBLEMS. RAPID WEIGHT LOSS IS WEIGHT LOSS OF MORE THAN 1 1/2 POUNDS TO 2 POUNDS PER WEEK OR WEIGHT LOSS OF MORE THAN 1 PERCENT OF BODY WEIGHT PER WEEK AFTER THE SECOND WEEK OF PARTICIPATION IN A WEIGHT-LOSS PROGRAM.
(B) CONSULT YOUR PERSONAL PHYSICIAN BEFORE STARTING ANY WEIGHT-LOSS PROGRAM.
(C) ONLY PERMANENT LIFESTYLE CHANGES, SUCH AS MAKING HEALTHFUL FOOD CHOICES AND INCREASING PHYSICAL ACTIVITY, PROMOTE LONG-TERM WEIGHT LOSS.
(D) QUALIFICATIONS OF THIS PROVIDER ARE AVAILABLE UPON REQUEST.
(E) YOU HAVE A RIGHT TO:
1. ASK QUESTIONS ABOUT THE POTENTIAL HEALTH RISKS OF THIS PROGRAM AND ITS NUTRITIONAL CONTENT, PSYCHOLOGICAL SUPPORT, AND EDUCATIONAL COMPONENTS.
2. RECEIVE AN ITEMIZED STATEMENT OF THE ACTUAL OR ESTIMATED PRICE OF THE WEIGHT-LOSS PROGRAM, INCLUDING EXTRA PRODUCTS, SERVICES, SUPPLEMENTS, EXAMINATIONS, AND LABORATORY TESTS.
3. KNOW THE ACTUAL OR ESTIMATED DURATION OF THE PROGRAM.
4. KNOW THE NAME, ADDRESS, AND QUALIFICATIONS OF THE DIETITIAN OR NUTRITIONIST WHO HAS REVIEWED AND APPROVED THE WEIGHT-LOSS PROGRAM ACCORDING TO s. 468.505(1)(j), FLORIDA STATUTES.
4.2 Hormone Replacement Therapy (HRT) and Peptides Treatments involving bio-identical hormones and peptides may utilize compounded medications. These substances are prepared by licensed compounding pharmacies and may not have been specifically approved by the FDA for the uses prescribed (“off-label use”). By consenting to treatment, you acknowledge that you have been informed of the investigational nature of certain therapies and that results are variable.
4.3 IV Vitamin Therapy IV Vitamin Therapy is a wellness service intended to support hydration and nutritional balance. It is not a treatment for acute medical conditions, infectious diseases, or chronic illnesses unless part of a broader medical treatment plan managed by a physician.
4.4 Body Contouring and “Health Studio” Disclaimer Services such as body contouring, slimming massages, and muscle recovery treatments are aesthetic and wellness procedures. Bogat Aesthetics & Wellness is a medical facility, not a “Health Studio” as defined by Florida Statute § 501.0125. Our services do not constitute instruction in a program of physical exercise. However, for your protection, we voluntarily align our membership cancellation policies with the consumer safeguards typically afforded to health studio contracts.
5. MEMBERSHIP, AUTO-RENEWAL, AND CANCELLATIONS
5.1 VIP Membership Auto-Renewal If you enroll in our VIP Membership program:
- Automatic Renewal Clause: Your membership is a continuous service that will automatically renew on a month-to-month basis upon the expiration of your initial term.
- Authorization: You affirmatively authorize us to charge your designated payment method for the recurring membership fee at the then-current rate until you cancel.
- Notification: For any membership term lasting 12 months or longer, we will provide written notice of the upcoming renewal between 30 and 60 days prior to the renewal date, as required by Florida Statute § 501.165.
5.2 Cancellation Policy
- Memberships: You may cancel your membership by providing 30 days’ written notice to [Insert Email].
- Statutory Cooling-Off Period: You have the right to cancel any membership agreement penalty-free within 3 days of signing the contract, exclusive of holidays and weekends. To cancel, mail or deliver a signed and dated notice which states that you, the buyer, are canceling this agreement, or words of similar effect.
- Appointments: We require at least 24 hours’ notice to cancel or reschedule a standard appointment. Cancellations made with less than 24 hours’ notice will incur a cancellation fee of $50 or forfeiture of the booking deposit.
6. REFUNDS AND RETURNS
6.1 Services All sales of services are final. We do not offer refunds on services rendered. Aesthetic outcomes are subjective and vary between individuals; dissatisfaction with a result is not grounds for a refund.
6.2 Retail Products
- Unopened Products: May be returned for store credit within 14 days of purchase if accompanied by a receipt.
- Opened Products: Due to health and hygiene regulations, we cannot accept returns on opened skincare products, makeup, or supplements. All sales of opened products are final.
6.3 Prescription Medications Pursuant to state and federal pharmacy regulations, prescription medications (including weight loss injectables, Latisse, etc.) cannot be returned or refunded once dispensed. This applies even if the medication remains unopened, as the chain of custody cannot be verified.
6.4 Gift Cards
- Purchased Gift Cards: Gift cards purchased for cash value do not expire and have no maintenance fees, in accordance with Florida Statute § 501.95.
- Promotional Cards: Gift cards or vouchers issued as part of a promotion, loyalty reward, or donation (where no monetary consideration was given by the consumer) may have an expiration date of one year from the date of issuance.
7. SMS MESSAGING TERMS (A2P 10DLC COMPLIANCE)
7.1 Program Description By providing your mobile phone number, you consent to receive recurring automated promotional and personalized marketing text (e.g., SMS and MMS) messages (e.g., cart reminders) from Bogat Aesthetics & Wellness, including text messages that may be sent using an automatic telephone dialing system, to the mobile telephone number you provided. Consent is not a condition of any purchase.
7.2 Content Scope Our SMS communications are limited to:
- Appointment reminders and confirmations.
- General wellness tips and account updates.
- Promotions for skincare and aesthetic services. Note: We do not send promotional SMS content regarding sexual wellness services. Information regarding these specific services must be accessed directly via our Website or in-person consultation.
7.3 User Choices
- Opt-Out: You can unsubscribe at any time by texting the word STOP to our number. You will receive a one-time opt-out confirmation text message.

- Cost: Message and data rates may apply.
- Frequency: Message frequency varies.
7.4 Privacy and Data Sharing We respect your privacy. We do not share, sell, or disclose your mobile phone number or opt-in data to third parties or affiliates for their marketing or promotional purposes. 8. INTELLECTUAL PROPERTY
The Website and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by the Company, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
9. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL BOGAT AESTHETICS & WELLNESS, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE WEBSITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE WEBSITE, OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
10. DISPUTE RESOLUTION AND BINDING ARBITRATION
10.1 Agreement to Arbitrate You and Bogat Aesthetics & Wellness agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or the use of the Website or services (collectively, “Disputes”), will be settled by binding arbitration, except that each party retains the right to bring an individual action in small claims court.
10.2 Class Action Waiver YOU AND BOGAT AESTHETICS & WELLNESS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and we agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.
10.3 Venue and Governing Law All matters relating to the Website and these Terms of Use, and any dispute or claim arising therefrom or related thereto, shall be governed by and construed in accordance with the laws of the State of Florida without giving effect to any choice or conflict of law provision. Any legal suit, action, or proceeding arising out of, or related to, these Terms of Use or the Website shall be instituted exclusively in the federal courts of the United States or the courts of the State of Florida, in each case located in Broward County.
